Selling a House During Divorce or Separation

When a shared home is part of a separation, a clear sale process can reduce uncertainty. Begin with the practical questions: who can authorize a sale, what needs agreement and what timing works.

Agree on the process before the price

Ask your own attorney which ownership, agreement or court requirements apply before making a commitment. We cannot resolve disagreements between owners, interpret a divorce order or advise how proceeds should be divided.

  • Who needs to participate in the sale decision?
  • Who should receive property communications?
  • Is there a move-out plan or a date that must be coordinated?
  • Are there instructions from your legal advisers that affect negotiations?

Compare the practical tradeoffs

A market listing may be worth considering when the owners can coordinate preparation, showings and a potentially longer timeline. A direct sale may be worth reviewing when the property needs work or coordinating access is difficult. Compare expected net proceeds and written conditions in either case.

Use the selling-options worksheet to organize estimates. Each owner should review the same assumptions rather than comparing a hoped-for listing price with a firm purchase proposal.

Prepare a simple property summary

  • Property address and the people authorized to discuss a sale.
  • Current occupancy, access arrangements and known repairs.
  • Approximate mortgage balance and known property obligations.
  • Asking price, desired timing and questions for your advisers.

You do not need to explain private relationship details to request a property review. Do not submit court records or sensitive personal documents through the general inquiry form.

Our role as a potential buyer

Sensible Property Solutions reviews the property as an investment. If a purchase fits, we discuss terms for the appropriate parties to review. Any purchase price is confirmed in written terms. If a direct purchase isn’t the best fit, we can help you explore other selling pathways that support your goals.
